Wills, Estate Planning, and Powers of Attorney
Planning for the future is one of the most meaningful steps you can take for yourself and your loved ones. While it can feel difficult to think about, having the right documents in place provides peace of mind and ensures that your wishes are respected.
Wills
A will is a legal document that sets out how you want your property and assets to be divided after your death. It also allows you to name an executor (as well as a back up executor) to carry out your instructions and wishes, and, if you have children, to appoint a guardian. Without a valid will, how your estate is divided will be based on the current law, which may not reflect your personal wishes or your family’s needs.
As part of discussions with respect to your will, we provide Estate Planning services, which looks at the bigger picture: your property, finances, and personal goals. Thoughtful estate planning can help minimize taxes, protect assets, and make things easier for your family.
Powers of Attorney
A power of attorney is just as important as a will. It is a legal document that gives someone you trust the authority to make decisions on your behalf if you are unable to do so because of illness, injury, or incapacity.
In Ontario, there are two main types:
-
This allows your chosen person to manage your financial matters, such as paying bills, handling bank accounts, filing taxes, and making decisions about your home or other property. You can decide whether it takes effect immediately or only if you become incapable.
-
This covers personal and health-related decisions, such as your medical care, housing, and other day-to-day matters. This ensures that someone you trust, who understands your values, will speak for you if you cannot.
Without a power of attorney, your loved ones may need to go to court or through a government process to be appointed to make these decisions, which can cause stress and delays at an already difficult time.
