What is Independent Legal Advice (ILA) and Why is it so important?

When navigating family law matters in Ontario, independent legal advice (ILA) plays a crucial role in ensuring that individuals make informed decisions which leads to stronger agreements and may prevent future disputes.

Independent legal advice refers to the process where a person consults a lawyer who is not associated with the other party in a legal matter. This ensures that individuals fully understand their rights, obligations, and the potential consequences of any legal agreement they are entering into. A lawyer providing ILA will review the terms of the agreement, explain the legal implications of the terms of the Agreement, and confirm that the client is making decisions voluntarily, without undue pressure or coercion. Your lawyer should also explain to you what the current law is and how your Agreement may follow or diverge from it and what the consequences of this may be.

    1. Ensures Fairness and Transparency:
      Family law agreements, such as Marriage Contracts and Separation Agreements, often involve complex legal and financial terms. Independent legal advice ensures that both parties understand what they are agreeing to and that the terms are fair and enforceable.

    2. Protects Against Future Challenges:
      One of the primary benefits of obtaining ILA is that it can help prevent an agreement from being challenged in court. If one party later claims they did not understand the agreement or was pressured into signing it, the fact that they received independent legal advice can serve as strong evidence that they made an informed decision.

    3. Identifies Potential Legal Issues:
      A lawyer providing ILA will identify any clauses in the agreement that may be problematic or unenforceable. They may also suggest modifications to better protect the client’s interests.

    4. Encourages Voluntary and Informed Decision-Making:
      The emotional nature of family law disputes can sometimes lead individuals to make hasty decisions. Having a lawyer review the agreement ensures that decisions are made rationally and with full knowledge of the legal ramifications.

  • While independent legal advice is not legally required, it is strongly recommended any time an individual is entering into an Agreement, including a:

    • Marriage Contract: Couples may sign a Marriage Contracts (either before or after their marriage) that outlines how assets will be divided in the event of separation.

    • Cohabitation Agreement: Couples living together may set out financial responsibilities and rights in case of separation.

    • Separation Agreement: After a breakup, partners may agree on child related issues (including decision making responsibility and parenting time) property division, child support and spousal support.

    • Parenting Plans or Parenting Agreement: After separation, parents may set out their parenting responsibilities about the care, decision-making, parenting-time, holiday time, and upbring of their child or children.

  • During an independent legal advice session, the lawyer will:

    1. Review of Your Agreement:
      We carefully examine the terms to identify any concerns or risks.

    2. One-on-One Legal Advice:
      You’ll receive clear explanations of your rights and options in plain language with an explanation of the current law and the legal terms and implications of the Agreement. During this meeting, the lawyer will provide suggestions on modifications to the Agreement.

    3. Certificate of Independent Legal Advice:
      Once satisfied that you understand the terms of the Agreement, you are not under any duress of coercion, and that the Agreement is lawful,  we provide the signed certificate of independent legal advice, if required.

  • Failing to obtain independent legal advice can lead to significant legal and financial risks, including:

    • Invalidated Agreements: Courts may set aside an agreement if one party did not understand its terms or was pressured into signing.

    • Unfair Settlements: Without legal guidance, one party may unknowingly agree to unfavorable terms.

    • Future Legal Disputes: Disagreements over the terms of an agreement can lead to costly future litigation.

  • The cost of ILA varies depending on the complexity of the Agreement as well as the lawyer’s experience. Given my years of experience, for a more straightforward agreement, I estimate that it would be about 3 to 5 hours of work. The range typically depends on the number of revisions required to the Agreement. While more complex agreements, such as separation agreements and marriage contracts with significant assets or complex parenting arrangements may take more time. Investing in ILA can help prevent costly legal litigation in the future and ensures that the Agreement is strong and enforceable which makes it a worthwhile expense.
